Terms of Service – Helpr™

These Terms of Service (“Terms”) govern your access to and use of Helpr™ services and systems. By subscribing, accessing, or using any of our services, you agree to be bound by these Terms.

Helpr™ is a marketing automation and reputation management service provider designed specifically for childcare businesses.


1. Scope of Services

Helpr™ provides digital tools and marketing automation services that may include:

  • Automated review collection and reputation improvement tools.

  • Enrolment lead generation and nurturing systems.

  • Tour scheduling support and follow-up automations.

  • Business analytics and reporting dashboards.

  • System onboarding, training, and implementation support.

  • Third-party platform integrations (e.g. Google Reviews, Facebook, Calendars).

These services are provided through our proprietary platform and via white-labeled CRM technology customised for childcare centres.


2. Subscription, Billing & Payment

  • All services are offered on a subscription basis, billed monthly in advance.

  • Subscription fees are fixed for the duration of your plan unless you upgrade or modify services.

  • Your service will be automatically suspended if a payment fails and will be reactivated upon successful payment of arrears.

  • We reserve the right to terminate the account permanently if payments remain unpaid for 7 days.

  • All fees are non-refundable, except where a specific money-back guarantee is triggered and validated (see section 4).

  • Upgrades or downgrades to your plan will take effect on the next billing cycle.


3. Client Obligations

To enable Helpr™ to deliver guaranteed results, you agree to:

  • Provide full access to systems necessary for integration (e.g. review platforms, booking calendars, GMB profiles).

  • Promptly respond to onboarding and setup requirements within 7 days of subscription.

  • Maintain active participation and communication with the Helpr™ team.

  • Keep payment information up to date to avoid service interruption.

Failure to meet these obligations may void all performance guarantees.


4. Performance Guarantees

Helpr™ offers Guaranteed Results (subject to client compliance):

  • 100% money-back if you do not achieve 2 new Enrolments in 60 Days.

  • We continue supporting you at no charge until target is hit.

To claim a refund under any plan’s guarantee, you must:

  • Complete onboarding within 7 days.

  • Keep your Helpr™ system connected and operational.

  • Have an active subscription with Helpr.

  • Respond to weekly check-ins and optimisation feedback.

  • Demonstrate no increase in enrolments or reviews based on our reporting dashboard

All refunds are subject to our internal validation and approval process.

Decisions will be communicated in writing and any refunds will be processed with 14 days.

The timeframe to request a refund is strictly within 90 days from the date of initial sign up.


5. Intellectual Property

All systems, copywriting, designs, workflows, and marketing materials created by Helpr™ remain the exclusive property of Helpr™ or its licensors.

You are granted a non-exclusive, non-transferable, revocable licence to use the materials and systems while your subscription is active.

You may not reverse engineer, copy, resell, or redistribute Helpr™ IP.


6. Confidentiality

All client data, strategies, and reports remain confidential and will not be shared or disclosed to third parties except as needed to fulfil services or by legal requirement.

Clients are also required to maintain confidentiality of Helpr™ processes, system setups, and internal communication.


7. Cancellation & Termination

You may cancel your subscription by providing 30 days’ written notice via email to [email protected]

Helpr™ may terminate service immediately for:

  • Repeated failed payments.

  • Abuse or misuse of system.

  • Illegal or unethical conduct.

  • Breach of these Terms.

On cancellation or termination, all access will be revoked and your data will be retained for 6 months before deletion.


8. Limitation of Liability

Helpr™ is not liable for:

  • Any indirect, incidental, or consequential damages.

  • Performance failures caused by external factors (e.g. third-party downtime, algorithm changes).

  • Loss of business resulting from misuse of the system or inaccurate data entry by the client.

Our maximum liability is limited to the total amount paid in the 60 days prior to a claim.

Helpr™ will not be liable for delays or failure in performance due to events beyond its reasonable control.


9. Modifications

Helpr™ may revise these Terms at any time with 14 days’ notice. Continued use of the service implies acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.
